Excerpt from the Care of Young Persons (Special Provisions) Act (1990:52)

Section 36
If the young person is aged 15 or over, he is entitled to speak on his own behalf in judicial and other proceedings under this Act.

A person appointed public counsel, pursuant to Section 39, for a person aged under 15 without also being counsel for the custodian is, without special appointment, the young person's proxy in the case or matter to which the appointment refers.

Children below this age should be given a hearing if this can benefit the investigation and if it may be presumed that the child will not suffer harm from being questioned.
